1. Agreement to Terms

By accessing or using ARRA HairTech software products and services provided by ARRA Hairdressers, Inc., you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access our services.

2. Services Description

ARRA HairTech provides comprehensive software solutions for beauty professionals including:

  • 3D hair modeling and visualization software
  • Augmented reality (AR) virtual try-on technology
  • Hair color simulation and matching tools
  • Salon and barbershop management systems
  • Appointment scheduling and booking platforms
  • Point-of-sale (POS) and inventory management
  • Client relationship management (CRM) tools
  • Marketing automation and analytics

3. Subscription Plans

Starter Plan - $199/month:

  • Up to 3 stylist accounts
  • Basic booking and scheduling system
  • 100 virtual try-on sessions per month
  • Client database (up to 500 clients)
  • Email support (24-hour response time)
  • Mobile app access

Professional Plan - $399/month:

  • Up to 10 stylist accounts
  • Advanced 3D hair modeling tools
  • Unlimited virtual try-on sessions
  • Complete POS and inventory system
  • Marketing automation features
  • Priority support (4-hour response time)
  • Custom branding options

Enterprise Plan - Custom Pricing:

  • Unlimited locations and stylists
  • Multi-location analytics dashboard
  • Custom API integrations
  • White-label software options
  • Dedicated account manager
  • 24/7 phone and email support
  • On-site training and implementation

4. Free Trial

  • 30-day free trial available for Starter and Professional plans
  • Full access to plan features during trial period
  • No credit card required to start trial
  • Automatic conversion to paid subscription unless cancelled
  • Trial data retained if converting to paid plan

5. Payment Terms

Billing:

  • Subscriptions billed monthly in advance
  • Payment due on subscription anniversary date
  • Accepted payment methods: Credit card, debit card, ACH transfer
  • Automatic renewal unless cancelled 7 days before renewal
  • Failed payments result in service suspension after 7 days
  • Late payments subject to 1.5% monthly interest

Setup and Implementation:

  • Starter: Self-service setup included
  • Professional: Remote onboarding session included
  • Enterprise: Custom implementation plan (fee varies)

6. User Obligations

Customers must:

  • Provide accurate business and billing information
  • Maintain secure account credentials
  • Use software in compliance with applicable laws
  • Not share account access with unauthorized users
  • Not reverse engineer, decompile, or modify software
  • Not use service for illegal or fraudulent purposes
  • Maintain adequate internet connection and devices
  • Keep software and apps updated to latest versions

7. Data and Content Ownership

Your Data:

  • You own all client data, photos, and business information
  • You grant us license to process data for service delivery
  • You can export your data at any time
  • Data deleted within 90 days after account termination

Our Property:

  • Software, algorithms, and technology remain our property
  • 3D models and AR technology are proprietary
  • We may use anonymized data for service improvement
  • We retain rights to software updates and enhancements

8. Service Availability

  • We aim for 99.5% uptime (excluding maintenance)
  • Scheduled maintenance communicated 48 hours in advance
  • Emergency maintenance may occur without notice
  • No service credits for downtime under 1 hour per month
  • Service credits: 5% of monthly fee per hour of additional downtime

9. Cancellation and Refunds

Cancellation:

  • Cancel anytime from account settings
  • Service continues until end of billing period
  • No partial month refunds
  • Data accessible for 30 days after cancellation

Refund Policy:

  • 14-day money-back guarantee for first month only
  • Must request refund within 14 days of initial payment
  • Refunds processed within 10 business days
  • No refunds for subsequent months or Enterprise plans

10. Software Updates

  • Regular updates and new features included
  • Critical security updates applied automatically
  • Major version updates may require user action
  • Legacy version support for 6 months after new release

11. Support Services

  • Starter: Email support, 24-hour response
  • Professional: Email and chat, 4-hour response
  • Enterprise: 24/7 phone, email, and chat support
  • Knowledge base and video tutorials available to all
  • Community forum access included

12. Warranties and Disclaimers

We Warrant:

  • Software will perform substantially as described
  • We will use reasonable security measures
  • Support services will be provided as stated

Important Disclaimer:

Software provided "AS IS" beyond stated warranties. No guarantee that virtual try-on results will exactly match final haircut results. Hair modeling is for visualization purposes only. We are not liable for client dissatisfaction with actual haircuts or colors.

13. Limitation of Liability

To the maximum extent permitted by law:

  • Total liability limited to fees paid in previous 3 months
  • Not liable for indirect, consequential, or punitive damages
  • Not liable for lost profits, revenue, or business opportunities
  • Not liable for data loss if proper backups not maintained
  • Not liable for third-party integrations or services
  • Not liable for client disputes related to services rendered

14. Indemnification

You agree to indemnify ARRA Hairdressers, Inc. from claims arising from:

  • Your use or misuse of the software
  • Violation of these Terms
  • Your services provided to clients
  • Content you upload or create
  • Violation of third-party rights

15. Third-Party Services

  • Payment processing via Stripe (subject to Stripe's terms)
  • Cloud hosting via AWS (subject to AWS terms)
  • Optional integrations available (separate terms apply)
  • We are not responsible for third-party service failures

16. Changes to Terms

  • We may modify these Terms with 30 days notice
  • Material changes communicated via email
  • Continued use after changes constitutes acceptance
  • You may cancel if you disagree with changes

17. Dispute Resolution

Governing Law:

These Terms are governed by the laws of the State of Ohio, USA.

Arbitration:

  • Disputes resolved through binding arbitration in Cleveland, OH
  • Arbitration under AAA Commercial Arbitration Rules
  • Each party bears own costs unless arbitrator decides otherwise
  • No class action arbitrations permitted

18. General Provisions

  • Entire agreement between parties
  • If any provision invalid, others remain in effect
  • Failure to enforce rights is not a waiver
  • You may not assign rights without written consent
  • Force majeure clause applies to unforeseen circumstances
